Chapel Springs Farm Liability Waiver

if you are booking XC schooling, you only need to fill out one liability waiver.

The “participant” has been given permission to come upon Chapel Springs Farm (hereinafter referred to as the “Owners Premises”) located in Free Union, Virginia owned by CS Farm, LLC (hereinafter referred to as “Owner”).
Participant acknowledges and understands that no warranty, either express or implied, is made by the Owner as to the condition of the Owners Premises. This document is to warn PARTICIPANT that dangerous conditions, risks, and hazards do exist on the Owners Premises. PARTICIPANT acknowledges that all activities on rural property such as the Owners Premises does have unknown hazards and risks and can result in injury or property damage to the person/persons involved in these activities. The many possibilities and sources of injury or damage are acknowledged by PARTICIPANT AND HE/SHE COMES ON THE Owners Premises with full knowledge that hazards and risks exist.
PARTICIPANT HEREBY INDEMNIFIES (RELEASES) OWNER from all liability for personal injury (including wrongful death) or property damage suffered by PARTICIPANT which is caused, in whole or in part, by any activity or condition on the Owners Premises. PARTICIPANT understands this agreement and has agreed that neither he/she, nor their heirs, or personal representatives will ever be able to sue OWNER or his associates for any injury or property damage that PARTICIPANT suffers while on the Owners Premises.
PARTICIPANT INDEMNIFIES AND RELEASES OWNER, EMPLOYEES, AGENTS, SUBCONTRACTORS FROM ALL LIABILITY. 
As used in this release agreement, the term “PARTICIPANT/PARTICIPANTS” will include any minors in the PARTICIPANTS care while on the Owners Premises. All PARTICIPANTS who bring minors understand the Owner is not responsible for the care or safety of minors. The PARTICIPANT (S) who bring minors onto the Owners Premises assumes the responsibility for watching and caring for the minor’s safety and guarding against hazards at all times.
PARTICIPANT HAS READ THIS DOCUMENT AND UNDERSTANDS IT. HE/SHE IS SIGNING IT FREELY AND VOLUNTARILY. To the extent any portion of this Agreement is deemed unenforceable, the remaining portions shall remain in full force and effect.  
PARTICIPANTS PLEDGE:
In return for the privilege of using private property, I agree to:
1. Respect the landowner’s property, going only where he designates and assume liability for my actions and my person while on this property.
2. Take every precaution against littering and fire
3. Obey game, fish, and other wildlife laws
4. Observe all safety precautions and the traditions of good sportsmanship
5. Notify the Manager of any hazards, broken fences, or loose dogs or horses.
6. Understand that HELMETS are required while horseback riding or biking.
